International Trade Commission’s ban on the sale of the Apple Watch Series 9 and Apple Watch Ultra has today come into full effect, with Apple unable to sell the two warbles online or at any of its retail locations across the United States as part of an ongoing patent infringement dispute over technology related to blood oxygen sensing.
In a statment shared on Tuesday, a spokesperson for the International Trade Commission has confirmed that the Biden administration chose not to overturn the ban, meaning that until further notice, Apple will not legally be able to sell its two newest Apple Watches in the United States.
Masimo, a medical technology company based in the US, filed a lawsuit against Apple, alleging patent infringement concerning blood oxygen sensing technology. This particular feature was introduced with the Apple Watch Series 6 in 2020, providing users with information about the oxygen levels in their blood, typically sought between 95% and 100%. Despite a hung jury in the lawsuit, on October 26, the commission declared Apple in violation and issued both a US import ban and a sales injunction.
Apple submitted an appeal to the U.S. Court of Appeals for the Federal Circuit in Washington and concurrently developed a software remedy, aiming to enable the resumption of its sales.
